The Real Estate practice group represents owners, investors, and developers in all aspects of their commercial real estate portfolios, including acquisition, financing, development, construction, management, and disposition.

Donahue Fitzgerald specializes in representing property owners, users, developers, lenders, and investors in commercial, office, residential, and mixed-use projects throughout the United States. We also represent investors, lenders, and borrowers in real estate financing projects and serve as general counsel to a number of real estate partnerships.

Our attorneys negotiate and draft property acquisition, disposition and lease agreements for stand-alone transactions and more complex, multiparty, multiple location transactions arising from business mergers, relocations, expansion, and downsizing. The firm has negotiated and directed thousands of real estate transactions for regional and national Fortune 500 grocery/supermarket, drug, and mass merchandising chains including American Stores Company and its subsidiaries (including Lucky Stores, Sav-On Drug Stores, Osco Drug Stores, and Jewel Food Stores), and Hancock Fabrics. Among the transactions we have handled are the $450 million sale of an 80-store discount chain, the sale of 85 properties across the country valued at $50 million, the sale of a 28-store chain in Arizona, and the disposition of 75 Florida properties valued at $150 million.

Donahue Fitzgerald’s construction practice encompasses design, development and construction agreements for shopping centers, office and retail buildings, manufacturing facilities, and warehouse space. We have represented clients throughout the development process, from raw land through final construction, handling contracts with architects, engineers, general contractors, and subcontractors.

We represent clients in real estate financing transactions and have negotiated over $1 billion of financing for the acquisition, leasing, construction, and development of real property involving major lenders throughout the United States.

Our attorneys are experienced in a wide range of land use matters and regularly represent clients before local and state regulatory agencies in development and redevelopment matters for small and large commercial projects. We have secured approvals for building demolitions and redevelopment of inner-city property and represented clients in negotiations over mandatory developer infrastructure improvements. The firm’s real estate litigators have successfully represented clients in the full range of disputes arising from the purchase, development, and management of real property.

Members of the Real Estate practice work closely with other practice groups to provide clients with a complete range of real estate services, including attorneys specializing in Litigation, Tax, Intellectual Property, and Employment matters. Working closely with these other groups, our attorneys are able to craft integrated business and legal solutions for our clients.
