ACBA Labor and Employment 2023 Symposium: From Courtroom to Workplace: Preserving Diversity in Light of Recent Ruling on Affirmative Action

Maureen Duffy, Melanie Kim, and Chris Nepacena are speaking on a panel titled “From Courtroom to Workplace: Preserving Diversity in Light of Recent Ruling on Affirmative Action” at the ACBA’s Labor & Employment Symposium on September 15, 2023.

The recent US Supreme Court opinion regarding affirmative action programs under Title VI (education) includes a concurrence from Justice Gorsuch which states he sees no reason for the law under Title VII (businesses) should be any different than what was just decided for Title VI. And yet, study after study after study show that companies in the top 25% for racial/ethnic and gender diversity were respectively 36% and 25% more likely to have superior financial returns. What can a company do in this new legal landscape? A lively panel of employment law attorneys will look closely at this issue, consider possible issues for companies in the immediate future, and possible approaches for companies to stay relevant, robust, successful, and within the parameters of the law.
