ABA’s 41st Forum on Franchising

Dawn Newton, franchise and distribution law specialist, will be co-presenting a program on compliance issues on a workshop called “Oh No, They Did What?! What Do We Do Now?” at the ABA’s 41st Annual Forum on Franchising in Nashville on October 10 -12, 2018.

The workshop will discuss risks and potential best practices for remedial actions when counsel discovers that a franchisor’s employee made a mistake in the franchise sales, registration or disclosure process. Topics will include what to do when:

  • a prospect was disclosed with the wrong FDD;
  • the franchisor failed to obtain a signed Item 23 receipt and/or failed to wait 14 days before letting the prospect sign the franchise agreement;
  • the salesperson provided undisclosed financial projections; and
  • there was a failure to properly document a transfer, expiration or renewal
